Boat Storage Rental Agreement
The purpose of the Anacortes Waterfront Alliance (AWA) is to improve water access for small boaters, especially those who sail/paddle/row. By engaging in the considerable administrative work to lease land from the Port of Anacortes and provide monthly rental opportunities for small boats, we are hoping to make boating easier and more available to our community. Proceeds from our operation will help generate funds for developing new community boating programs, supporting youth sailing, and continuing our efforts to gain meaningful waterfront access for small boating. The AWA wants our tenant boaters to enjoy fair rates and access to the water with a minimum of fuss while helping improve upland facilities in the long term. Our rules for the storage yard are intended to be fair and to minimize the demands on our volunteer coordinators and organization. The following “Rules of Storage” shall apply:
1. Boats stored in the north basin fenced yard will be rated based on the named and listed length of the vessel (ie R20, Rhodes 19, Montgomery 17). Although rates are based on bareboat dimensions, the yard will not accommodate boats in excess of 28’ LOA, Trailer/boat combinations in excess of 30’ LOA, and vessel or trailer beams in excess of 9’.
2. Rate of rental will be calculated as follows:
a. Vessels under 20’ LOA =$75/Month
b. Vessels 20’ LOA - 24’ LOA = $90/Month
c. Vessels >24’ LOA - 28’ LOA = $110/Month
To encourage long-term tenants, if the year’s rental is paid in advance, the annual rental will be reduced by one month (Monthly Rate X 11).
3. Kayaks which can be accommodated on a rack in the west corner of the north basin yard will be subject to a flat 25$/ Month rate. If year round storage is desired, this rate is also subject to a 11 month rate ($275 annually). It is strongly recommended that smaller craft be secured to the rack with lock and cable.
4. Bareboats 14’ LOA and under may be accommodated on the Q dock dinghy float. These slips are limited to vessels with a maximum beam of 6’ or less and a smooth bottom or retractable centerboard for ease of pulling the boat up onto the float. Rates for the dinghy float are $35/ Month also subject to a 11 month rate ( $385 annually). Rollers, cleats and other hardware may be added based on the discretion of the yardmaster.
5. Yard limitations: Preference in storage will be given on the following priority basis: a) to muscle/sail powered boats; b) to year-long tenants; c) to boats which can be hoisted at the Port of Anacortes Small Boat Lift (weight limit approximately 3400#, length limit 27’); d) lastly, motor powered boats and dinghies. Boats unable to be hoisted or hand launched at the PQ area and power boats will be handled on a space available basis and may be displaced by higher priority boats.
6. AWA wants to enable active boaters to get into the water easily and frequently. Therefore, AWA reserves the right to terminate this rental agreement with 60 days notice for very infrequent users.
7. Spaces will be assigned by the yard-master in order to allow the yard to function for all tenants. The yard-master and yard committee have the ability to reassign boat areas and restripe the yard as needed to achieve best occupancy and least conflict between craft.
8. Tenants will receive an invoice to their email address. Invoices can be paid with a credit card or bank transfer.
9. This rental agreement is between AWA and the tenant and is not transferable.
10. Tenants must inform AWA of changes in address or phone contact number.
11. Tenants must have proof of vessel ownership and proof of insurance. Many homeowner insurance policies may meet these needs for smaller craft; riders to such policies or boat insurance may be needed in other cases.
12. Delinquency: Boats whose owners fail to pay rent for 30 days may be moved or towed at owner’s expense and risk.
13. Behavior: Boats stored in the yard must be kept in a clean and ready-to-launch condition. Minor maintenance of boats is acceptable in the yard but no hull painting, application of chemicals, hull scrubbing or other environmentally and neighbor unfriendly activities will be allowed in the yard.
14. All boats and craft whether bare or on trailers must be physically secured / restrained and made stable by their owners. AWA is not liable for boats that are blown off their stands/trailers or onto other boats.
15. The boat storage yard is secured with a fence in a patrolled area of the Port of Anacortes. The gates are locked cooperatively (tenants share access to the lock number). Damage due to theft or vandalism in the semi-secured yard is not the liability of the AWA or Port of Anacortes.
I hereby release, hold harmless and agree not to sue the Anacortes Waterfront Alliance, its officers, trustees, agents, and staff including employees, volunteers and interns (“Released Parties”), with respect to any and all claims of loss or damage to person or property by reason of injury, disability, death, or otherwise, suffered by me arising in whole or part from this rental agreement . I agree further to indemnify (“indemnify” meaning to defend, and to pay or reimburse, including costs and attorney’s fees) Released Parties against any claim by a member of my family, or any other person, arising in whole or part from an injury or other loss suffered by me or caused by me in connection with this storage agreement . These agreements of Release and Indemnity include claims of negligence of a Released Party, but not of gross negligence or intentionally wrongful conduct. They are intended to be enforced to the fullest extent permitted by law
